Supreme Court declines to restrain Arunachal Governor from swearing in as new CM

New Delhi: An interim order in connection with the plea seeking the restraining of the Arunachal Pradesh Governor- J. P. Rakhowa from swearing in a new Government in the Politically- gragile state which is also now under the rule of President, is declined by the honourable Apex Court.

The honourable Supreme Court of India has also refused to allow the prayer of the Congress leaders who preferred this plea, where maintaining of the status quo in crisis- hit Arunachal Pradesh was sought.

Such plea by the Congress leaders is dealing with by the Five- Judges constitution bench of the honourable Supreme Court of India, which is led by Justice J.S. Khehar. On this Tuesday, when the Bench which is also comprising of Justice Dipak Misra, Justice P.C. Ghose, Justice M. B. Lokur and Justice N. V. Ramana, also said that after hearing the petitioners on the Injunction plea, the Court cannot propose to pass any order and as such the matter will be heard on merits.

However, as per Attorney General Mukul Rohatgi, who after coming to know about the Congres leaders seeking status quo on possible political developments in the state rushed the Court and said that the constitutional authority cannot be pre-empted by the Court from taking any decision.

Moreover, he further said that the Court cannot annulled the decision of the Constitutional Authority, however, the concerned application was remarked by him as misconceived. Thus, the Attorney General- Rohatgi had remarked all this for opposing the said application in which the Congress leaders have expressed the apprehension of withdrawing of the proclamation of central rule.

Moreover, it was found notably that there was exchange of words between the senior advocates who were appearing for both parties, on the authenticity of the press release purportedly issued by the Rajkhowa’s office.

However, the Court’s concerned bench finally, told the senior advocate Fali S. Nariman and Kapil Sibal, that the concerned order is suggested as fit at this juncture and if these Congress leaders do not accept the same, then they must argue on merits.
