Bombay High Court passes Adarsh Society Building’s demolition order

Mumbai: Corruption being the evil in the society and dangerous for the nation’s growth, a strong oppose is shown through the verdict of the High Court of Bombay, as it has today, on Friday, 29th April, ordered for the demolition of the thirty- one storey Adarsh Co- operative Housing Society Building.
This strong message is showing that the Indian Judiciary is prompt against the evils prevailing in the society and the wrongdoers will always be punished. The present order as has been directed by the high Court of Bombay against the Union Environment Ministry, and it has asked it to demolish the said building, which was constructed from the corrupted monies.

However, the judiciary being bound by the various laws, when the counsel appearing for the said Adarsh housing society claimed for a twelve- week’s stay on the said demolition, so as to allow it to appeal in the Top Court of the country, the High Court granted the said stay on the said demolition order. However, the said claim of stay was objected by the State and also by the Environment authorities. Not only such demolition, the Court also found directing the State to start Criminal Prosecution against the officials who were involved in such Adarsh Society Scam and also asked it to restore the plot.

It was seen that earlier an order for demolition of the said society building was passed by the Union Ministry of Environment and Forests- MOEF and in this wake, the Court also passed the much similar order. It was in the year 2011, (January) the said Ministry found ordering the demolition of the said Society building within three months. And it had termed the said society as ‘unauthorized’ building for violating coastal regulations.

After such order from the Union Ministry, the members of the society rushed to the court and challenged the said order, but the court did not agree with their contentions, and confirmed the said demolition should be done. Now, court also directed the Defence Ministry, that the departmental inquiry be conducted against the officers involved in the instances of not taking actions earlier.
