Coaching centres in residential areas were ‘nuisance against women and elderly’: SC refuses relief against eviction notices

New Delhi: Yesterday, on 8th day of March, the honourable Supreme Court stated that the Coaching Centres in the residential areas were a nuisance to women and the elderly people, thus, such Coaching Centres must shift out to commercial premises or institutional areas.

The decision is made by the bench of the Apex Court comprising of the Chief Justice of India- T. S. Thakur and U. U. Lalit who have also refused the petitioner’s claim and denied any relief to them.

The petition was preferred by the All Rajasthan Coaching Institutes Association, where they had challenged the eviction order served on its members by the Jaipur Development Authority, following the order of the High Court of the Rajasthan which had banned the functioning of the tutorials from the residential colonies. Such ban was claimed to be the illegal ban, as was sought to maintain by the petitioner.

The present concerned bench have further observed that the youngsters come with the bikes, in morning and evening and there can be seen many loiter around, harassing women and old people. Thus, the Court has decided to shift the Coaching centres out to the commercial premises or institutional areas. And the Court denied to offer any permission to such Coaching Centres to run in residential areas.

The petition in his plea is represented by the senior advocate- Kapil Sibal who have tried his best to get an interim relief on the eviction notice. He also argued before the Apex Court that the Authority imposing such banning order and issuing the notice, was not in jurisdiction, however, it was beyond the jurisdiction of the authority. Around 118 Coaching Institutes were issued eviction notices operating from the Lal Kothi residential area in Jaipur.

However, the Bench of the Apex Court did not found any merit in such arguments and in result it has declined to offer any relief in favour of petitioner. Thus, now the Coaching Centres are finally shown by the Apex Court to follow the directions provided in the notices in their hands.
