Rahul Gandhi is Bound to Appear Before Lower Court

Congress Vice President and leader Rahul Gandhi is supposed to pay heavy price for his remark for accusing RSS party for the Murder of Father of Nation Mahatma Gandhi, as he currently facing a strong set back by the Bombay High Court on Tuesday dismissing his petition to quash the defamation suit filed against him.

Mr Gandhi during his election campaign last year at Bhiwandi accused RSS that RSS people had Mahatma Gandhi and on March 7 he stated that ‘RSS killers are now using Mahatma Gandhi’s Name”. Subsequent to his speech Mr Rajesh Kunte an RSS functionary from Bhiwandi filed defamation suit against Mr Gandhi at Bhiwandi court. The Bhiwandi Court had directed Mr Gandhi to appear before the court last year.

 Instead of appearance Mr Gandhi filed petition before the Bombay High Court stating that he may be exempted from his personal appearance before Bhiwandi court as the complaint against him is made out of malafide intention and politically motivated. He submitted that there is no criminal case against him. An interim relief was granted earlier to him by the high court as the matter was kept for orders till Tuesday.

Mr Kunte, the respondent vehemently argued that the complaint was not a malafide one and it states the reckless remark of Mr Gandhi falsely accusing the RSS party. He argued that since complaint is filed before Bhiwandi Court Mr Gandhi is bound to appear before Bhiwandi court for trial. More over he submitted before the High Court that if Mr Gandhi can reach and conduct rally and deliver speech at Bhiwandi during election period he is capable of appearing before the Bhiwandi Court for complaint’s trial.

The Maharashtra Government had also submitted its strong objection to Mr Gandhi’s petition stating that since the trial is ongoing before the lower court, technically Mr Gandhi should personally appear before Bhiwandi court to adduce evidence for the completion of trial. In order to comply the order of the Honorable High Court now Mr Gandhi is bound to personally present before the Bhiwandi court for adducing evidence on the matter for the trial.
