The Goa, Daman and Diu (Administration) Act has been incorporated on 27th March 1962. This Act has been enacted in benefit of administration of Goa, Daman and Diu and such other matters to be administrated in pursuance of this Act.
In matter relating to administration, certain Officers were appointed. These Officers work in pursuance to Goa, Daman and Diu. The Central Government without any injustice to its powers can appoint Judicial Officers, Judges, Magistrates and such other Officer who should be at legal power of administration and Judiciary in Goa, Daman and Diu as may be necessary in pursuance to this Act. They should be in active administration in any field as needed in pursuance to this Act, immediately before the commencement of this Act.
All the laws in force shall be in effect immediately before the appointment day in Goa, Daman and Diu or any such parts till there were any amendments or repeals by the competent legislature or any authority holding such powers.
The Central Government may by proceeding with the application for the introduction of any laws in relation to Administration of Goa, Daman and Diu in accordance with the provisions of Constitution. The Central Government should enforce any rules or regulations within the period of two years from the commencement of this Act. It has the power to pass such Order to modify or amend or repeal any laws or rules as may be necessary.
The Central Government has powers to modify any laws at anytime with the Official notification in the Official Gazette. It may extend or restrict any enactments that are made in Goa, Daman and Diu through such notifications.
In order to facilitate an application to enforce any laws in Goa, Daman and Diu, the Central Government has the power to interpret or even any competent Judiciary Officers and Judges can interpret without changing its objective as may be necessary to adopt in any Court or before any other competent authority.
In case of any action taken or not taken by any administrative Officers or executive Officers or any other person in pursuance to Goa, Daman and Diu in good faith before the commencement of this Act and immediately after the appointment date shall be held valid and executed as it has been done in accordance with law.
There shall be no legal proceedings before any Court or any such places, in case of any action taken or not taken by any administrative Officers or any such Officers of the Central Government in Goa, Daman and Diu in good faith before the commencement of this Act but after the appointment date.
In case of any difficulties arise while making provisions in pursuance to this Act in connection with the administration shall be removed by the Central Government by making such Order as it make necessary to do so for the benefit of this Act. Any such Order shall be retrospective not before the appointment date but may be before the commencement of this Act and after the date of appointment.
The Goa, Daman and Dui (Administration) Ordinance, 1962 is hereby repealed any other provisions that are not repealed shall function as conferred by this Act.
