Supreme Court may see Venue of Kanhaiya’s Trial, considering the security issue

New Delhi: Shifting of Trial of JNUSU President and accused of Sedition- Kanhaiya Kumar may be considered by the honourable Supreme Court of India. Court has also condemned strongly the section of lawyers for indulging in shameful violence at the Patiala House Court complex.

The Apex court has felt the condemning of the action by lawyers twice in the three days. Moreover, the Top Court’s bench comprising of Justice J Chelameswar and A. M. Sapre asked whether the proceedings in the case should continue at Patiala House Court?

Also, Supreme Court’s concerned bench asked it after the panel of Six- member Lawyers which was appointed by the Top Court, reported that at 2 pm on the concerned day, the completed lawlessness prevailed in the Trial Court Complex. However, the heavy Police presence along with CISF personnel was there at the time when Kanhaiya was produced in the Court.

Moreover, the Bench of Top Court said that the lawyers will not be allowed to take law into their hands and even nobody will be allowed for denigrating the Justice delivery system.

However, Senior Advocate- Ajit Sinha while representing the Delhi Police contented that the said incident was ‘regrettable’.

The Court had passed the order in the morning of the day on which the incident taken place, where the Delhi Police was directed to provide utmost security to the Accused and also to the Six- lawyers representing them also it was directed by the court to ban entry of general public into the Trial Court room. Even this order was directed, the violence was taken place, and this anguished the Court most. Moreover, in the said order, the court had also directed two each of relatives of the accused, teachers and students would be allowed to enter along with the 5 journalists into the Trial Court room.

As such, as the advocate Dushyant Dave, advocate Kapil Sibal, advocate Rajeev Dhavan, advocate Indira Jaising, advocate Prashant Bhushan and advocate Raju Ramachandran suggested that the atmosphere was not favourable for the Fair Trial, the concerned Bench of the Supreme Court has decided to consider the issue on Monday.
