Today the bench of Justice Pratibha Rani of Delhi High Court has granted interim bail to Kanhaiya Kumar for six months. The Court said, he has to co-operate with the current investigation and also present before them when required by the investigators. Kanhaiya Kumar is under judicial custody and lodged in Tihar jail when the order was pronounced.
The bench allowed the relief to Kanhaiya who is instantly held up in Tihar prison by asking him to furnish a personal bond of Rs 10,000 and a surety of like sum. The high court made it clear that a JNU employee needs to remain as surety for Kanhaiya. Further, it said that the accused needs to outfit an endeavor that he won’t violate any of the conditions specified in the order granting bail to him.
Yesterday, Justice Pratibha Rani had reserved the order after hearing the plea for more than three hours, of Kanhaiya who is accused for raising anti-India slogans inside JNU amid an occasion sorted out on February 9. Later was arrested on February 12 and registered case under sections 124 A (sedition) and 120B (criminal conspiracy) of the IPC by the police.
Kanhaiya’s counsel argued that he had never raised any anti-India slogans but, police had claimed that he and others were shouting anti-India slogans with Parliament attack convict Afzal Guru’s poster. Moreover, he was not cooperating with the investigation and had given contradictory statements to IB and to Delhi Police. The defence lawyer had countered these allegations by saying that “some outsiders with covered faces who raised anti-India slogans and Kanhaiya was seen in CCTV footage asking them for their identity cards.”
During the hearing, the bench also asked tough questions to police for evidence against Kanhaiya of his “active role” in raising anti- India slogans. Finally, granted bail to JNUSU president Kanhaiya Kumar on Wednesday evening.
