ASSOCHAM is organizing 3rd International Conference on “Competition Law: Successes, Challenges and Reforms” on May 2, 2015

The ASSOCHAM is planning to conduct the 3rd International Conference on Competition Law: Successes, Challenges and Reforms at Hotel Shangri-La in New Delhi on May 2, 2015. The main areas under discussion will be:

  • Cartel, Bid rigging, Exclusivity, Refusal to Deal, Tie-in, Resale Price Maintenance Enforcement Activities:

The cartel as well as bid rigging is considered as the destructive type of anti competitive activities. The collection of evidence in this regard will be difficult for both CCI and DG. If the evidence is collected, then the process becomes simple when considered with various types of anti-competitive activities. Moreover, the vertical restraints which form of contracts are justifiable. The economic defenses are not strong in vertical contract when taking as safeguard against cartel. The significance of economic scrutiny are justified with regard to the assertions of vertical restraints when taken with direct proof that comes out of application with less penalty in the issues on cartels. These areas will be under discussion in the conference by the delegates. The major questions will be whether the confidential data protections can be considered as normal process or becomes a challenge?

  • Abuse of dominance:

In this topic the key points under discussion will be how will a venture under governance abuse its own position among the different market powers? The panel will also consider the opinion of CCI and COMPAT in this regard. Other point will be the role of IPR and the decisions abroad how far affects the decisions taken by CCI and COMPAT? It is also said that economic scrutiny has an important point in the competition assessment at global level. The conference will discuss the role of India in this connection.

  • Compliance issues:

The in-house compliance assists to lessen the risk that is faced by corporate sector. The conference will deal with the question whether the process of compliance should start from the top level to low level management.
