Section 66A of IT Act, a dead provision has been made alive by Thane Police

Sanjeev Shivadekar has reported that even though so much criticised Section 66A of the IT Act which is almost dead, as it was struck down by the apex court two weeks ago as unconstitutional is present for Thane Police.  A complaint was lodged against a person for posting hate posts against Mr Modi on FB under Section 66A of the IT Act, which is a dead provision in Rabodi Police Station.  An FIR was lodged on April 5, 2015 under the above said section against the owner of Revelation Tanzeel page on Facebook and the complaint was given by a Rabodi resident.  Contents that were posted on the FB page was very abusive and it directed to Mr Modi and so police filed a case against owner of Revelation Tanzeel.

Mayekar who is a 42 year old person who works in a bank had approached police control room and then his call was transferred to Kapurbawdi station then to Rabodi station.  The owner of the above said page on FB had tagged this message to many of his online friends which included a friend who worked in Aviation industry.  Mayekar further stated that the controversial post was cleared when an FIR was made against him but he also said that there was another post which had commented about Indian Army online to damage it was still present.

When asked Mr M D Survase who is the SI of the said police station stated that no arrest was made yet and further when told that Section 66A was struck down SC, will the investigation continue he told that he was busy and did not reply to the question.  Param Bir Singh who is Thane Police Commissioner told that he had no idea about this case and so could not comment on it without knowing the matter.  Police Officials from Rabodi police station and cyber cell in Thane rejected to reply to the question asked on the case.

As per the legal experts opinion FIR cannot be altered but the error that has occurred in the Police Station which was done by the police can be clearly undone.
