New Delhi: The honourable Uttarakhand High Court, on today, i.e. on 9th May dismissed the petition of nine Congress Members of Legislative Assembly through which they were challenging the decision of Speaker for their disqualification. Now this decision is immediately challenged by the rebels before the honourable Supreme Court of India.
The said decision by the honourable High Court of Uttarakhand’s single judge bench of Justice- U. C. Dhyani was came by dismissing the petition and besides such dismissal the court also asked the said Members of legislative assembly of Uttarakhand that to go back to the Speaker, namely, Govind Singh Kunjwal and ask for the review of his action if they so wished.
Moreover, it is notable here that the said decision will surely be making the task of the Bhartiya Janata Party much difficult in the confidence vote which is to be sought by Rawat tomorrow as it will be left with the only twenty- eight members of the said legislative assembly, in which a member, namely, Bhim Lal Arya is also including whose loyalty to the party is now in doubt.
Also notably, the said member- Bhim Lal Arya even after the suspension effected by the Bhartiya Janata Party, he remains to represent the party in the House. Thus, here it can be safely said that, this may be giving Rawat an advantage in the floor test which will now be held in the Assembly with an effective strength of sixty- two in which the winner’s side will be requiring only 31st members for a majority proof.
However, it is again notable here, that soon the High Court has delivered its verdict, the said MLAs approached to the Apex Court with an immediate effect.
It is also seen that the said Members’ representing counsel- namely, C. A. Sundaram found mentioning the matter before the honourable Chief justice of India- T. S. Thakur and told the Apex Court that the High Court’s verdict had come earlier in today. But, now the Chief Justice has asked the said counsel to take the matter before the bench which has already delivered the Friday’s order for the floor test.
